1. Introduction

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Veesa Solutions Ltd (trading as Veesa Solutions), a company registered in Kenya with its principal place of business at Bazaar Plaza, 1 Moi Avenue, Nairobi ("we", "us", or "our").

By accessing our website at veesasolutions.co.ke or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Payment Terms, and Returns & Refunds Policy.

2. Definitions

  • "Order" means a request by you to purchase one or more Products through our website.
  • "Product" means any goods listed for sale on our website, including electronics, accessories, and related items.
  • "Account" means your registered user profile on our platform.
  • "M-Pesa" means the mobile money service operated by Safaricom PLC.
  • "COD" means Cash on Delivery, a payment method available exclusively within Nairobi County.

3. Eligibility

You must be at least 18 years of age to place an order. By using our services, you represent and warrant that you have the legal capacity to enter into a binding agreement. By completing registration or placing an order, you confirm you are 18 or above.

4. Products & Pricing

  • All prices are displayed in Kenya Shillings (KSh) and are inclusive of applicable taxes unless otherwise stated.
  • We make every effort to ensure pricing accuracy. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund before dispatch.
  • The price at the time you place your order is the price you pay. We will not retrospectively increase prices on confirmed orders.
  • Product images and descriptions are provided for illustration purposes. Minor variations may occur between images and the actual product. It is your responsibility to review the full product description before ordering.

5. Orders & Payment

  • An order is only confirmed after successful payment via M-Pesa (all counties) or Cash on Delivery (Nairobi County only).
  • M-Pesa payments are processed via Safaricom's Daraja API. You will receive an STK Push on your registered phone to authorise payment.
  • We reserve the right to refuse or cancel any order due to stock unavailability, suspected fraud, pricing errors, or failure to verify payment.
  • Order cancellation requests must be submitted before dispatch. Once an order is dispatched, the Returns & Refunds Policy applies.

6. Shipping & Delivery

  • We deliver to all 47 Kenyan counties. Shipping fees and estimated delivery times are calculated at checkout based on your county.
  • Nairobi: 1–2 business days | Major towns: 3–5 business days | Remote areas: 5–7 business days.
  • Risk of loss or damage transfers to you upon delivery. We recommend inspecting items in the presence of the delivery personnel before signing.
  • Delivery times are estimates and not guaranteed. We are not liable for delays caused by force majeure, courier issues, or incorrect address information provided by you.

7. Returns & Warranty

Returns are accepted within 5 calendar daysof delivery in accordance with our Returns & Refunds Policy. Electronics that arrive defective (Dead on Arrival) qualify for free replacement or full refund if reported within 48 hours of delivery. Exchanges may be requested within 2 calendar days of delivery.

8. Account & Security

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • We will never ask for your M-Pesa PIN, password, or OTP via email, phone, SMS, or chat. If anyone contacts you claiming to represent Veesa Solutions and requests this information, do not respond and report it immediately to orders@veesasolutions.co.ke.
  • We reserve the right to suspend or terminate accounts engaged in fraudulent activity, including but not limited to: initiating M-Pesa reversals after receiving goods, providing false delivery information, or creating multiple accounts to exploit promotions.

9. Intellectual Property

All content on this website — including but not limited to text, graphics, logos, images, product descriptions, and software — is the property of Veesa Solutions Ltd or its licensors and is protected by the Copyright Act (Cap. 130) and the Kenya Industrial Property Act, 2001. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

10. Data Protection

Veesa Solutions Ltd is a registered data controller within the meaning of the Data Protection Act, 2019 (No. 24 of 2019). We process your personal data lawfully, fairly, and in a transparent manner in accordance with Section 25 of the Act. No clause in these Terms limits, excludes, or waives any right of a data subject under the Act.

You have rights under Section 26 of the Act, including the right to access, correct, delete, restrict, and object to the processing of your personal data. To exercise any right, contact privacy@veesasolutions.co.ke. Full details are in our Privacy Policy.

11. Limitation of Liability

  • To the maximum extent permitted by Kenyan law, Veesa Solutions Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products.
  • Our total liability for any claim arising from an order shall not exceed the total amount paid for that specific order.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Kenyan law, including liability under the Consumer Protection Act, 2012.

12. Dispute Resolution

In the event of a dispute arising from these Terms or any transaction:

  1. Negotiation: Contact us at orders@veesasolutions.co.ke or 0700 548177. We will endeavour to resolve the matter within 14 business days.
  2. Mediation: If negotiation fails, either party may refer the dispute to mediation under the Nairobi Centre for International Arbitration.
  3. Litigation: If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.

13. Governing Law

These Terms shall be governed by and construed in accordance with the Laws of Kenya, including but not limited to the Consumer Protection Act, 2012, the Data Protection Act (No. 24 of 2019), the Sale of Goods Act (Cap. 31), and the Contract Act (Cap. 23B). The courts of Nairobi shall have exclusive jurisdiction.

14. Changes to These Terms

  • We reserve the right to amend these Terms at any time. Any changes will be posted on this page with an updated "Last Updated" date.
  • For material changes that significantly affect your rights, we will notify you by email or through a prominent notice on our website at least 14 days before the changes take effect.
  • Your continued use of our website or services after the revised Terms have been posted constitutes your acceptance of the updated Terms.
  • If you do not agree with any changes, you should stop using our services. Existing orders placed before the change will be governed by the Terms in effect at the time of the order.
